Terms of Service

Last updated: April 2026

A. For Creators

1. Platform fee

BuyMeACroissant charges a flat 4 % platform fee on every successful transaction, deducted via Mollie's applicationFee mechanism. This is in addition to Mollie's own payment-service-provider (PSP) fees, which the creator bears.

2. Payout flow

Payments are processed by Mollie Connect. Once a payment is confirmed, Mollie transfers the net amount (minus PSP fee and platform fee) directly to the creator's connected bank account according to Mollie's payout schedule. BuyMeACroissant does not hold creator funds.

3. DAC7 acknowledgement

BuyMeACroissant operates as a "digital platform" under EU Directive 2021/514 (DAC7). Creators who exceed €2 000 in annual consideration or 30 transactions per year will have their data reported to the relevant tax authority. By creating an account, you consent to this reporting obligation.

4. VAT self-certification

BuyMeACroissant is a payment service provider, not a Merchant of Record. Each creator is the legal seller of their goods and services and is solely responsible for determining, collecting, and remitting any applicable VAT or sales tax under their local jurisdiction (including EU OSS/MOSS where applicable). By signing up, you self-certify your VAT status and country of residence.

5. Account suspension

Accounts that have not completed Mollie identity verification (mollie_onboarding_status = 'completed') and DAC7 tax certification within 30 days of registration may be suspended until verification is complete. Public profiles remain visible but payment generation is blocked for unverified creators.

B. For Buyers

6. Refund policy

Tips are voluntary contributions and are generally non-refundable. Refunds may be issued at the creator's discretion or in cases of confirmed fraud. Contact the creator directly or reach us at hello@buymeacroissant.eu.

7. Digital goods — no right of withdrawal after delivery

For purchases of digital products (e.g. PDF downloads), the right of withdrawal under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) does not apply once delivery has commenced and you have given explicit prior consent to this exception. By clicking "Pay", you expressly consent to immediate delivery and acknowledge that you lose your right of withdrawal upon download.

C. General

These Terms are governed by German law. Any disputes shall be subject to the exclusive jurisdiction of the courts in [City], Germany. We reserve the right to update these Terms; continued use of the platform constitutes acceptance.
